Can the ThinkSecret web site win?

I found this pretty cool article entitled "ThinkSecret lawyer slams Apple 'intimidation'". Here's a snippet:

Apple is suing the site for allegedly releasing 'trade secrets'. Terry Gross, a former counsel for the Electronic Frontier Foundation who is representing the site and its owner, 19-year old student Nick Ciarelli, claimed that Apple 'filed against ThinkSecret because they believed that they wouldn't have enough resources to fight this, and that they would cave and then that would set an example to other journalists who are not with any major media organisation.'
I'm really rooting for the ThinkSecret guy. I really don't think that corporations should be able to intimidate the little guy. Corporations think they can send out a ceast and desist order and then be done with it. People need to stand up for themselves and fight back.

I hope they do, Apple should be investigating who leaked the information in the first place and go after them, not the messenger (ThinkSecret). If it wasn't for sites like his, they wouldn't be receiving all the publicity that their new products have received.

Well I think alot of it is intended by Apple... they have enough money to play the lawyer game, so they will. They are only attacking one person... not full scale war right now.

I don't know if this was just a cease and desist. It sounds a little bit more serious.

But I think anything more serious than that will probably be thrown out of court. It sounds like they have a good lawyer :)

I agree with you that Apple has enough money to play the lawyer game so they will go ahead and see if they can win. By the way, the kid got a lawyer who is doing a good job so far in representing him.
